If you do not accept these terms, you may not </div><div>view or otherwise use the Data for any purpose. These restrictions on use </div><div>of the Data apply to you and to any officer, employee, agent, transferee,</div><div>vendee or other end user of yours (collectively, “users”). If you transfer to,</div><div>or use the Data in connection with, any such end user in a format or context</div><div>revealing Cowlitz County as the source of the Data, you agree to inform such</div><div>user(s), by copy of these Terms of Use or otherwise, that County does not</div><div>warrant the Data in any way and makes each of the disclaimers set forth</div><div>below. </div><div><br /></div><div>LIABILITY/DISCLAIMER:</div><div>All Cowlitz County GIS data is expressly provided “AS IS” and</div><div>“WITH ALL FAULTS”. The County makes no warranty of any kind, express</div><div>or implied, concerning the accuracy this information, including without</div><div>limitation to the condition of the Data, or its fitness for any particular purpose.</div><div>The burden for determining fitness for use lies entirely with the user. In no</div><div>event shall County assume responsibility or legal liability concerning the</div><div>Data’s accuracy, reliability, completeness, timeliness, or usefulness.</div><div><br /></div><div>Further, and although this data have been processed on computers of County,</div><div>no warranty, expressed or implied, is made by County regarding the use</div><div>of this Data on any other system, nor does the fact of distribution constitute</div><div>or imply any such warranty. In no event shall County have any liability</div><div>whatsoever for payment of consequential, incidental, indirect, special, or</div><div>tort damages of any kind, including, but not limited to, any loss of profits</div><div>arising out of use of or reliance on the geographic data or arising out of</div><div>the delivery, installation, operation, or support by County.</div><div><br /></div><div>Data is collected from various sources, and may be modified by County</div><div>over time and without notice to improve spatial and attribute accuracy.</div><div>The County disclaims responsibility for the spatial accuracy and attribution</div><div>of GIS features, and makes no warranty concerning same. </div><div><br /></div><div>NO AUTHORITY TO REPRESENT COUNTY:</div><div>Users are not authorized by County to combine this Data with other data</div><div>with the intent or effect of representing as County or a function including</div><div>but not limited to, matters relating to land development, permitting, or flood</div><div>hazard evaluation. When using this Data, a user has no authority to</div><div>represent its products or services as a County authorized agent or</div><div>representative. Maps or applications using this Data may not include the</div><div>Cowlitz County logo, or any content suggesting use of the Data is</div><div>associated with or approved by Cowlitz County. County may require the</div><div>termination of any and all display, distribution or use of any or all of the Data</div><div>for any reason including, without limitation, for violation of this provision and</div><div>any other provision of these Terms of Use.</div><div><br /></div><div>DATA CURRENCY:</div><div>This Data may be updated at irregular intervals.
